1. SALE OF GOODS

The gift certificates purchased are made pursuant to a shipment contract. Title to the goods passes to the buyer upon delivery to the shipping carrier.

2. RISK OF LOSS

We are not responsible for gift certificates lost or stolen after delivery to the shipping carrier.

3. CREDIT CARD REQUIREMENTS

We do not sell gift certificates to anyone under the age of 18. By making this purchase you are verifying that you are of the age of majority. A minor may make a purchase with his/her parent’s or guardian’s consent, and that parent or guardian’s credit card number.

4. PRIVACY

We do not sell or distribute any personal or confidential information of our customers to anyone. We shall endeavor to use reasonable security measures in our shopping cart and merchant account pursuant to industry standards.

5. RIGHT TO REFUSE

We shall reserve the right to refuse service to anyone for any reason. If we refuse service, the customer’s account will not be charged, the order will be cancelled, and the customer will be notified.

6. FULFILLMENT

We fulfill each order within 24-48 hours of purchase pursuant to the customer’s shipment preference. The customer’s credit card is not charged until the order has been completed.

7. DISCREPANCIES

In the event that the advertised price and the gift certificate price are not equal, we reserve the right to correct the proper pricing pursuant to our agreement with the third party vendor. We reserve the right to supply less than the selected quantity, with notice to the customer, if the order exceeds the maximum allowance. We will notify the customer and the proper charge accordingly.

8. WARRANTIES

All express and implied warranties shall be subject to Article 2 of the Uniform Commercial Code (UCC).

9. SELLER’S RIGHTS

In addition to other express rights in this agreement, we have the right to include promotional material and/or other inserts in the transaction at no additional cost to the customer. The views and opinions expressed by the third party vendors do not necessarily represent the views of the seller. We reserve the right to amend these terms and conditions at any time, for any reason.

10. BUYER’S RIGHTS

The buyer has the right to receive the goods ordered pursuant to the purchase confirmation, subject to the terms of this agreement. The customer will be charged the proper total and receive prompt delivery of the goods pursuant to the terms of this agreement. The buyer has the right to cancel the sale up to the time of fulfillment, at which time there is no refund.

11. BUSINESS CLOSURES

It is the buyer’s responsibility to confirm the validity of the business’ current operations. We cannot issue refunds for businesses that close after the sale.
